We asked our (very expensive) lawyers for a privacy policy, and it came back a lot longer and scarier-looking than we thought it would be (they said they're just doing their job, but they also bill us by the hour...). It's too expensive to ask them to shorten this document, so we'll try to explain the parts we think you're here to see:

  • We NEVER sell user data
  • We don't require you to give us your name or email to create an account (or ask you to create a password), so unless you send us your email or name, we won't even know who you are
  • We use anonymous analytics only to improve the app

Enhanced Radar Corporation (“Enhanced Radar” “we,” “us,” and “our”) respects your privacy and is committed to protecting it through compliance with this Privacy Policy (this “Policy”).

This Policy describes how we collect, use, and share personal information of consumer users of Enhanced Radar's mobile apps, websites, content, products, and any related services (together, the “Services”).

This Policy applies to personal information that we collect:

  • From you directly.
  • Through any of the Services.
  • In electronic messages between you and any of our personnel or any automated agents enabled through any of the Services.
  • When you interact with our advertising on third-party websites and services, if that advertising includes links to the Services where this policy governs.

This Policy does not apply to information collected by:

  • By our affiliates or subsidiaries, separately from us.
  • Any third party, including through any application or content that may link to or be accessible from or through the Services.

Please read this policy carefully to understand how we will treat your information. If you do not agree with this policy, your choice is not to use THE SERVICES. By accessing or using ANY OF THE SERVICES, you agree to this policy. This policy may change from time to time (see Updates To This Privacy Policy). Your continued use of ANY OF THE SERVICES after we make changes to this policy is deemed to be acceptance of those changes, so please check this policy periodically for updates.

1. Personal Information We Collect

We collect personal information about you in a number of different ways:

Personal Information Collected from You. When you use any of the Services, we collect information (a) by which you or your household may be personally identified, related, or described and (b) that is reasonably capable of identifying you or your household when we combine it with other information (collectively, “personal information”). Personal information may include the following categories, depending on how you use any of the Services and how you communicate with us:

  • Individual identifiers, such as name and date of birth;
  • Contact information, such as mailing address, phone number, and email address;
  • Commercial information, such as products or services purchased, obtained, or considered;
  • Communications with us and preferences, such as any messages, opinions, and feedback that you share with us when you contact us directly (such as for customer support services) and your user preferences (such as in receiving updates or marketing information);
  • Personal financial and billing information; and
  • Additional information as otherwise described to you at the point of collection or pursuant to your consent.

Sensitive Information. We may need to collect or process personal information that is deemed “sensitive information” or “sensitive data” under certain laws. We may process the following categories of sensitive information when you use any of the Services:

  • Geolocation data, such as your physical location if you have enabled location services on your device; and
  • Authentication data, such as account personal information and login credentials, including unique identifiers like account ID and password.

Information We Collect Automatically. The Services may automatically collect the following categories of usage and technical personal information about you. This personal information is used by Enhanced Radar for the operation of the Services, to maintain quality of the Services, and to provide general statistics regarding use of the Services. This personal information may include:

  • IP address, which is the number associated with the service through which you access the Internet, like your ISP (internet service provider);
  • Date and time of your visit to or use of the Services;
  • Domain server from which you are using the Services;
  • Type of computer, web browsers, search engine used, operating system, or platform you use;
  • Data identifying the web pages you visited prior to and after use of our Services;
  • Your movement and activity within the Services, including but not limited to what elements of the Services you use; and
  • Mobile device information, including the type of device you use, operating system version, and the device identifier (or “UDID”).

The technologies we use for this automatic data collection may include:

  • Cookies. We may log information using “cookies.” Cookies are small data files stored on your hard drive by a website. We may use both session Cookies (which expire once you close your web browser or mobile app) and persistent Cookies (which stay on your computer or mobile device until you delete them) to provide you with a more personal and interactive experience on the Services.
  • Web Beacons. Pages of our websites and mobile apps and our emails may contain small electronic files known as web beacons (also referred to as clear gifs, pixel tags, and single-pixel gifs) that permit us, for example, to count users who have visited those pages or opened an email and for other related website or mobile app statistics (for example, recording the popularity of certain website or mobile app content and verifying system and server integrity).
  • Device Identifiers. When you access the Services by or through a mobile device (including but not limited to smart phones or tablets), we may access, collect, monitor, and/or remotely store one or more “device identifiers,” such as a universally unique identifier, which are small data files or similar data structures. A device identifier may remain persistently on your device, to help you log in faster and enhance your navigation through the Services. Some features of the Services may not function properly if use or availability of device identifiers is impaired or disabled.

Information We May Receive from Third Parties. We may collect additional personal information about you from third-party websites, social media platforms and/or sources providing publicly available information ( e.g., from the U.S. postal service) to help us provide the Services to you, to manage your account, to maintain our customer/visitors lists, to provide feedback, for authentication purposes, for service improvement, to provide updates and announcements, to help prevent fraud, and for marketing and advertising purposes. This Policy only applies to personal information collected by the Services. We are not responsible for the privacy and security practices of those other websites or social media platforms or the personal information that they may collect. You should contact such third parties directly to determine their respective privacy policies. Links to any other websites or content do not constitute or imply an endorsement or recommendation by us of the linked website, social media platform, and/or content. As you are using the Services, you may click through certain links or promotions that will enable you to purchase products or use services provided by promotional partners or other sites or commerce providers. Some of those entities may share with us certain information that you provide to them.

Additional Information. If you choose to transmit additional personal information through the Services that is only optional for you to provide to us, we will collect that personal information that you provide and use it in the same manner as other if your personal information that you provide to us.

Information About Third Parties. You shall not provide us with personal information regarding another individual unless you have the consent to do so.

2. How We Use Your Personal Information

Generally, we may use your personal information in the following ways and as otherwise described in this Policy or described to you at the time we collect the personal information from you:

  • To Provide the Services and Personalize Your Experience. We use personal information about you to provide the Services to you, to personalize your experience with the Services, to manage your account, and to respond to your inquiries and questions and provide customer service.
  • Transactions. We use your personal information to carry out our obligations and enforce our rights arising from any contracts entered into between you and us, including for billing.
  • Changes. We use your personal information to notify you about changes to any Services.
  • Improvement of the Services. We may use your personal information to maintain, improve, customize, or administer the Services, perform business analyses, or other internal purposes to improve the quality of our business and the Services, resolve technical problems, or improve security or develop other products and services.
  • Creating Deidentified or Other Anonymous Data. We may create de-identified or other anonymous data from personal information we collect. We make personal information into de-identified or other anonymous data by removing information that makes the data personally identifiable to you. We may use this de-identified and other anonymous data and share it with third parties for our lawful business purposes as permitted by law.
  • Company Operations. We may use personal information for our day-to-day operations, including for employment and administrative purposes and for security, company systems, compliance, and database use.
  • Marketing. We may use your personal information in connection with sending you marketing communications, including by mail and email as permitted by law. You may opt out of marketing communications from us by following the unsubscribe instructions in the marketing communications or through the other methods as further described below in Your Choices Regarding Your Personal Information.
  • Third-Party Relationships. We may use your personal information to manage, improve, and foster relationships with third-party service providers, including vendors, suppliers, and parents, affiliates, subsidiaries, and business partners.
  • Compliance and Protection. We may use any of the categories of personal information described above to:
    • Comply with applicable laws, lawful requests, and legal process, such as to respond to subpoenas or requests from government authorities;
    • Protect our, your, and others’ rights, privacy, safety, and property (including by making and defending legal claims);
    • Audit our internal processes for compliance with legal and contractual requirements and internal policies;
    • Enforce the terms and conditions that govern the Services; and
    • Prevent, identify, investigate and deter fraudulent, harmful, unauthorized, unethical, or illegal activity, including cyberattacks and identity theft.
  • With Your Consent. If you provide us with express consent or expressly instruct us to share your personal information with a third party, we may do so.

3. How We Share Your Personal Information

We may disclose de-identified or anonymous information about our users, and information that does not identify any individual, without restriction. We may disclose all categories of your personal information described above with the following categories of third parties:

  • Affiliates. We may share your personal information with our affiliates for purposes consistent with this Policy.
  • Third-Party Service Providers. We may provide your personal information to third-party service providers that help us provide you with any Services and to operate our business (for example, web services operators and credit card billing partners). We sometimes utilize third-party service providers to help us track analytics information. We may disclose your personal information to track your movement and use of the Services. Such data may be stored and analyzed for purposes of internal analysis by Enhanced Radar.
  • Professional Advisors. We may provide your personal information to our lawyers, accountants, bankers, and other outside professional advisors in the course of the services they provide to us.
  • Corporate Restructuring. We may share some or all of your personal information in connection with, or during negotiation of, any merger, financing, acquisition or dissolution, transaction, or proceeding involving the sale, transfer, divestiture, or disclosure of all or a portion of our business or assets. In the event of an insolvency, bankruptcy, or receivership, personal information may also be transferred as a business asset. If another company acquires Enhanced Radar or our business or assets, that company will possess the personal information collected by us and will assume the rights and obligations regarding your personal information described in this Policy.
  • Other Disclosures. We may disclose your personal information if we believe in good faith that such disclosure is necessary for any of the following:
    • In connection with a legal investigation;
    • To comply with relevant laws or to respond to subpoenas or warrants served on Enhanced Radar;
    • To protect or defend the rights or property of Enhanced Radar or users of the Website or Services; and/or
    • To investigate or assist in preventing any violation or potential violation of the law, this Policy, or our Terms of Service or other agreement between you and us.
  • Third-Party Websites. The Services may contain links to third-party websites. When you click on a link to any other website or location, you will leave the Services and go to another website, and another entity may collect your personal information from you. We have no control over, do not review, and cannot be responsible for these outside websites or their content or any collection of your personal information after you click on links to such outside websites. The links to third-party websites are for your convenience and do not signify our endorsement of such third parties or their products, content, websites, or privacy practices.
  • With Your Consent. If you provide us with express consent or expressly instruct us to share your personal information with a specific third party or type of third party, we may do so.

Use and Disclosure of Sensitive Information. Notwithstanding the foregoing to the contrary, we do not collect, use, or disclose your sensitive information beyond the purposes authorized by the applicable law. Accordingly, we only use and disclose your sensitive information as reasonably necessary and proportionate: (i) to perform the Services requested by you; (ii) to help ensure security and integrity, including to prevent, detect, and investigate security incidents; (iii) to detect, prevent and respond to malicious, fraudulent, deceptive, or illegal conduct; (iv) to verify or maintain the quality and safety of the Services; (v) for compliance with our legal obligations; (vi) with our service providers who perform the Services requested by you on our behalf; and (vii) for purposes other than inferring characteristics about you.

4. Your Choices Regarding Your Personal Information

You have several choices regarding the use of your personal information through the Services:

Email Communications. We may periodically send you emails that directly promote the use of the Services. When you receive such emails from us, you may indicate a preference to stop receiving further emails, and you will have the opportunity to “opt out” by following the unsubscribe instructions provided in the email you receive or by emailing us directly at support@atc.com. Despite your indicated email preferences, we may send you Services-related communications, including notices of any updates to this Policy or the Terms of Service.

Cookies. If you decide at any time that you no longer wish to accept cookies for any of the purposes described above, then you can instruct your browser, by changing its settings, to stop accepting cookies or to prompt you before accepting a cookie from the websites you visit. Consult your browser’s technical information. If you do not accept cookies, however, you may not be able to use all functionality of the Services. Notice of Privacy Rights for Residents of Certain U.S. States.

Residents of certain U.S. states may have rights and choices regarding their personal information. To the extent any state data protection law applies to our collection of your personal information, this supplemental section of the Policy outlines the individual rights you may be entitled to and how to exercise those rights. Depending on where you live and subject to certain exceptions, you may have some or all of the following rights.

  • Right to Know and Access. You may have the right to request that we confirm whether we process your personal information, and to request information about our collection and use of your personal information. You may also have the right to request access to personal information we may process about you.
  • Right to Data Portability. Where the processing is carried out by automated means, and subject to certain exceptions, you may have the right to request and obtain a copy of your personal information that you previously provided to us in a portable format. In addition, to the extent technically feasible, you may have the right to obtain your personal information in a readily usable format that allows you to transmit the personal information to another data controller without hindrance.
  • Right to Request Correction of Inaccurate Information. To the extent that we may maintain inaccurate personal information, you may have the right to request that we correct such inaccurate personal information, taking into account the nature of the personal information and the purposes of the processing of the personal information.
  • Right to Request Deletion. You may have the right to request that we delete certain personal information or records provided by or obtained about you, with certain exceptions and limitations as allowed under law.
  • Right to Limit Use and Disclosure of Sensitive Information. You may have the right to request that we limit the ways we use and disclose your sensitive personal information to uses which are necessary for us to perform the Services and as authorized by law. As noted elsewhere we do not use or disclose your sensitive personal information other than for the permitted business purposes outlined above.
  • Right to Non-Discrimination. You may have a right to not be discriminated against in the Services or quality of Services you receive from us for exercising your rights. We will not discriminate against you for exercising any of your rights in this section including denying goods or Services, charging different prices or rates for goods or Services, or providing a different level of quality of goods and Services.
  • Right to Disclosure of Direct Marketers. You may have a right to know the categories and names/addresses of third parties that have received personal information for their direct marketing purposes upon simple request, and free of charge.
  • Right to Appeal. You may have the right to appeal our denial of any request you make under this section. To exercise your right to appeal, please submit an appeal request via the information in the Contact Us section below. Within the certain timeframe of receipt of your appeal, as proscribed by the applicable law, we will inform you in writing of any action taken or not taken in response to your appeal, including a written explanation of the reasons for the decisions. If we deny your appeal, you may contact the Attorney General or another authority which we will help you identify.

To learn more about whether you are guaranteed certain rights, or to submit a request to exercise your rights, please contact us using any of the methods in the Contact Us section. To exercise any of the rights described above, please submit a verifiable consumer request to us via the methods described below. The verifiable consumer request must:

  • Provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information, or an authorized representative; and
  • Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

To help protect your privacy and maintain security, if you request access to or deletion of your personal information, we will take steps and may require you to provide certain information to verify your identity before granting you access to your personal information or complying with your request. In addition, if you ask us to provide you with specific pieces of personal information, we may require you to sign a declaration under penalty of perjury that you are the consumer whose Information is the subject of the request.

If permitted by the applicable data protection law, you may use an authorized agent to submit requests on your behalf provided that the authorized agent is a natural person or a business entity that you have authorized to act on your behalf. If you use an authorized agent, we will require: (1) proof of written permission for the authorized agent to make requests on your behalf, and identity verification from you; or (2) proof of power of attorney pursuant under applicable law. Only you or your authorized agent may make a verifiable consumer request related to your personal information. We may deny a request from an authorized agent that does not submit proper verification proof. You may also make a verifiable consumer request on behalf of your minor child.

5. Security Of Your Personal Information

Enhanced Radar is committed to protecting the security of your personal information. We use a variety of security technologies and procedures to help protect your personal information from unauthorized access, use, or disclosure. No method of transmission over the internet, or method of electronic storage, is 100% secure, however. Therefore, while we use reasonable efforts to protect your personal information, we cannot guarantee its absolute security.

6. Retention of Personal Information

We keep your personal information only as long as necessary to use it as we have described in this Policy.

7. International Users

Please note that the Services are hosted in the United States. If you use any of the Services from outside the United States, please be aware that your personal information may be transferred to, stored, and processed in the United States. The data protection and privacy laws of the United States may differ from the laws in your country. By using any of the Services, you consent to the transfer of your personal information to the United States.

8. Notice to European Users

The information provided in this “Notice to European Users” section applies only to individuals in Europe, including the United Kingdom and Switzerland.

Personal Information. References to “personal information” in this Policy are equivalent to “personal data” governed by European data protection legislation.

Controller. We are the controller of your personal information covered by this Policy for the purposes of European data protection legislation. We have appointed a Data Protection Officer, whose contact information is: Eric Button, Enhanced Radar Corporation, 2824 Folsom Street, San Francisco, California 94110, USA, eric@enhancedradar.com.

Legal Bases for Processing. We use your personal information only as permitted by law. Our legal bases for processing the personal information described in this Policy are described in the table below.

Use for New Purposes. We may use your personal information for reasons not described in this Policy, where permitted by law and the reason is compatible with the purpose for which we collected it. If we need to use your personal information for an unrelated purpose, we will notify you and explain the applicable legal basis.

Sensitive Personal Information. Except as referenced in this Policy, we ask that you not provide us with any sensitive personal information ( e.g. , information related to racial or ethnic origin, political opinions, religion or other beliefs, health, biometrics or genetic characteristics, criminal background, or trade union membership) on or through the Services or otherwise to us. If you provide us with any sensitive personal information when you use the Services, you must consent to our processing and use of such sensitive personal information in accordance with this Policy. If you do not consent to our processing and use of such sensitive personal information, you must not submit such sensitive personal information through the Services.

Automated Decision-Making and Profiling. Other than for the purposes of verifying your identity to help you manage your account, we do not use automated decision-making and/or profiling in regard to your personal information in connection with the Services.

Retention. We retain personal information for as long as necessary to fulfill the purposes for which we collected it, including for the purposes of satisfying any legal, accounting, or reporting requirements, to establish or defend legal claims, or for fraud prevention purposes. To determine the appropriate retention period for personal information, we consider the amount, nature, and sensitivity of the personal information, the potential risk of harm from unauthorized use or disclosure of your personal information, the purposes for which we process your personal information and whether we can achieve those purposes through other means, and the applicable legal requirements. When we no longer require the personal information we have collected about you, we will either delete or anonymize it or, if this is not possible (for example, because your personal information has been stored in backup archives), then we will securely store your personal information and isolate it from any further processing until deletion is possible. If we anonymize your personal information (so that it can no longer be associated with you), we may use that anonymized information indefinitely without further notice to you.

Your Rights. European data protection laws give you certain rights regarding your personal information. If you are located within the European Economic Area or Switzerland, you may ask us to take the following actions in relation to your personal information that we hold:

  • Access. Provide you with information about our processing of your personal information and give you access to your personal information.
  • Correct. Update or correct inaccuracies in your personal information.
  • Delete. Delete your personal information.
  • Transfer. Transfer a machine-readable copy of your personal information to a third party of your choice.
  • Restrict. Restrict processing of your personal information.
  • Object. Object to our reliance on our legitimate interests as a legal basis of our processing of your personal information that impacts your rights.

You may submit these requests by email to support@atc.com or our postal address provided below. We may request specific information from you to help us confirm your identity and process your request. Applicable law may require or permit us to decline your request. If we decline your request, we will tell you why, subject to legal restrictions. If you would like to submit a complaint about our use of your personal information or our response to your requests regarding your personal information, you may contact us or submit a complaint to the data protection regulator in your jurisdiction. Cross-Border Data Transfer. If we transfer your personal information out of Europe to a country not deemed by the European Commission to provide an adequate level of personal information protection, the transfer will be performed:

  • Pursuant to the recipient’s compliance with Standard Contractual Clauses or Binding Corporate Rules;
  • Pursuant to the consent of the individual to whom the personal information pertains; or
  • As otherwise permitted by applicable European requirements.

9. Notice to Canadian Users

The information provided in this Section applies only to individuals in Canada. Individuals located in Canada have certain rights pursuant to Canada’s Personal Information Protection and Electronic Documents Act (PIPEDA) and any applicable substantially similar provincial legislation (“ Canadian Data Protection Legislation ”).

Personal Information. References to “personal information” in this Policy are equivalent to “personal information” governed by Canadian Data Protection Legislation.

Consent. By using the Services and providing personal information to us, you are consenting to the collection, use, and disclosure of your personal information as described in this Policy. If you do not consent to the processing of your personal information in accordance with this Policy, please do not access or continue to use the Services or otherwise provide any personal information to us.

Your Rights. You have certain rights with respect to your personal information under Canadian Data Protection Legislation. Subject to certain exceptions and limitations, and depending upon the province where you reside, such rights may include:

  • To Withdraw Consent. The right to withdraw your consent to the collection, use, or disclosure of your personal information.
  • To Be Informed. The right to be informed of the existence, use, and disclosure of your personal information and to be provided with an account of the use that has been made or is being made of this information as well as the third parties to which it has been disclosed (including a list of organizations to which your information may have disclosed).
  • To Correct. The right to challenge the accuracy and completeness of your personal information and have it amended, updated, or rectified as appropriate.
  • To Challenge. The right to challenge our compliance with the applicable Canadian Data Protection Legislation.
  • To Be Forgotten. The right to restrict the dissemination of your personal information in certain circumstances if such dissemination contravenes a law or court order or otherwise causes serious injury to your reputation or privacy.
  • Data Portability. The right to receive computerized personal information in a structured, commonly-used and technological format, or to have such personal information transferred directly to any person or body authorized by law to collect such personal information.

Automated Decision-Making. We do not use automated decision-making in regard to your personal information in connection with the Services.

Complaints. The Office of the Privacy Commissioner of Canada (Commissariat à la protection de la vie privée du Canada) advises individuals to file an objection or challenge with the relevant company before lodging a formal complaint with a regulatory authority. If you are dissatisfied with our response to an objection or inquiry, or you if wish to file a complaint with a regulatory authority first, you may file a complaint with the Office of the Privacy Commissioner of Canada. Depending upon the province where you live, you may also (or instead) have the right to file a complaint with the applicable provincial privacy commissioner/regulator.

10. Notice to Australian and New Zealand Users

Information about Enhanced Radar. This Policy protects all the personal information that we collect and helps ensure that personal information is handled properly, including in accordance with the Australian Privacy Act, if you are an individual in Australia, and the New Zealand Privacy Act 2020, if you are an individual in New Zealand. The below statements, together with the statements in the remainder of this Policy, explain our practices for collecting personal information subject to the Australian Privacy Principles (the “APPs”) and the New Zealand Information Privacy Principles (the “IPPs”).

The Purposes for Collecting Personal Information. In addition to the purposes for collecting your personal information that we have set forth above in the How We Use Your Personal Information Section, we will collect your personal information for purposes as permitted by the APPs or the IPPs (as applicable), such as when the use or disclosure is needed to protect you, us, or others from threats (such as security threats or fraud) or cheating and to comply with the laws that are applicable to us around the world.

Whether Collection of your Personal Information is Required by Law. In most cases, you are not required by law to provide any personal information to Enhanced Radar. You are required to provide certain personal information to enable us to provide you with the Services. We indicate which data elements are required for the provision of the Services. If you do not provide these data elements, we cannot provide the Services to you.

Exercising your Privacy Rights – ANZ Opt Out. In addition to the rights described throughout this Policy, you may elect not to receive future communications from us by sending an e-mail stating your wishes to support@atc.com or by following the unsubscribe link in any of such communications. We will respond to your privacy rights requests in accordance with applicable law.

Cross-border Disclosures from Australia. We may generally disclose your personal information to our affiliates and service providers and others, and these entities may be located outside of Australia. We take reasonable steps to ensure that any overseas recipient complies with the APPs with respect to your personal information and remain accountable to you for compliance in accordance with APP 8.

Cross-border Disclosures from New Zealand. We may generally disclose your personal information to our affiliates and service providers and others, and these entities may be located outside of New Zealand. We only make cross-border disclosures of your personal information to those entities that are: (i) subject to the Privacy Act 2020, (ii) subject to a privacy law that provides a comparable level of protection, (iii) is contractually obligated to protect the information appropriately, using model contracts, or (iv) where the disclosure is otherwise permitted by IPP 12.

Complaints

  • Australian Residents: If you believe that we have violated any of the Australian Privacy Principles, you can contact us here: Contact Us. We will investigate your complaint and try to resolve any issue to your satisfaction. If we do not adequately answer your concerns, you will have the right to make a complaint in writing to the Office of the Australian Information Commissioner, https://www.oaic.gov.au/.
  • New Zealand Residents: If you believe that we have violated the Privacy Act 2020, you can contact us here: Contact Us. We will investigate your complaint and try to resolve any issue to your satisfaction.
